The Tunica-Biloxi Tribe of Louisiana unveiled plans to launch the first-ever Tribal prediction market application in partnership with Kalshi, following the issuance of a no-action letter from the Commodity Futures Trading Commission (CFTC) to authorize participation.
"This partnership represents exactly the type of opportunity Indian Country should be pursuing, where Tribes are owners, innovators and leaders, not just participants," Tunica-Biloxi Chairman Marshall Pierite said.
"For generations, the Tunica-Biloxi people have adapted, traded and built relationships that allowed our Nation to prosper. This initiative carries that tradition into the modern economy and demonstrates what is possible when Tribal entrepreneurship is paired with emerging technology and innovative vision."
The Louisiana Tribe intends to establish a new subdivision – SaltTrade Derivatives – which will focus on providing software for trading event contracts offered by Kalshi, although the application “may branch out into other offerings as opportunities arise.”
The new application is currently being developed around “market access, transparency and responsible oversight.”
Kalshi Co-Founder and CEO Tarek Mansour also spoke on the inaugural launch, having said, "Indian Country should have more paths to economic self-determination, not fewer and we're proud to partner with the Tunica-Biloxi Tribe as the first Tribal nation to enter prediction markets.
"The debate can no longer be reduced to prediction markets on one side and Tribes on the other. What's clear is that regulated national infrastructure and Tribal entrepreneurship can develop together — and one does not have to lose for the other to win."
Despite Mansor’s apparent optimism, Tribal pushback to event contract trading was displayed as recently as September 18, when the Poarch Band of Creek Indians called on the CFTC to immediately crack down on prediction markets following a closed-door meeting with agency officials.
"The Poarch Band of Creek Indians and the State of Alabama prohibit online gambling and underage gambling within our jurisdictions. The CFTC's effort to federalize these decisions directly violates Tribal and state sovereignty while disregarding the choices we have made to protect our young people," Poarch Band of Creek Indians Vice Chairman Robbie McGhee said.
"The Commission's own proposed rule acknowledges that prediction markets are susceptible to addictive behavior, yet it dismisses those concerns by claiming prohibitions will simply push the activity offshore. More troubling, the proposal never considers the dangers of exposing 18- to 20-year-olds to sports gambling under the misleading guise of financial products."
According to the Tunica-Biloxi Tribe of Louisiana, additional information regarding the application and its launch will be released “in the coming months,” and confirmed its platform will not be registered with the CFTC.
Indian Gaming Association Chairman David Bean also testified before a US House Agricultural Subcommittee in Washington DC during July, where he discussed “significant concerns” prediction markets could pose for Tribal gaming.
