Stake Brasil has obtained a partial preliminary injunction allowing it to continue operating fixed-odds betting in Brazil until 25 October 2026, or an earlier court decision, despite the national shutdown required by Provisional Measure 1,394/2026.
The 9th Federal Civil Court of São Paulo provisionally preserved the effect of Stake’s existing authorisation. Authorities may not block or redirect stake.bet.br solely on the basis of its anticipated expiry, or sanction the company solely for operating within the order’s limits.
The ruling applies to Stake’s authorised activities and does not suspend the measure for the wider market.
The judge refused Stake’s primary request to maintain operations through December 2029, the original expiry of its authorisation. The court noted that the measure required betting platforms to go offline from 6 October while setting 25 October as the date existing authorisations would expire.
It considered that mismatch in granting temporary relief, without deciding whether the measure itself is unconstitutional.
Stake must continue age verification, anti-money laundering controls, self-exclusion and responsible gambling measures.
The order also bars new promotional campaigns and acquisition bonuses, requires access to player withdrawals and sufficient funds for balances, and prohibits betting with social welfare payments.
In a statement, Stake welcomed what it described as recognition of the importance of legal certainty for operators that paid authorisation fees and invested in the regulated market. The company said it had complied with the provisional measure and would continue to follow the court’s directions.
Stake believes it is the first licensed operator to secure such relief.
The decision gives Stake a short, conditional period of operation while the broader ban and legal challenges continue.
Brazil’s betting platforms went offline from 6 October under the provisional measure, while industry associations challenged the ban in the Supreme Federal Court. Authorities have also reported extensive efforts to block unauthorised betting sites.
Stake faces separate legal scrutiny outside of Brazil too. Florida has sued over the Stake.us sweepstakes platform, while regulators in Lagos have challenged Stake.com’s licensing status in Nigeria.
