The Buenos Aires City Lottery has begun implementing mandatory training programs for cashiers who have been charged with violating Article 301 bis of Argentina’s Penal Code, as part of probation agreements applied in cases involving illegal gaming in Buenos Aires.
The training sessions are established as conduct rules within the framework of suspended proceedings, a legal mechanism that allows defendants to avoid trial by complying with specific obligations. These agreements are reached between the accused individuals and the Specialized Prosecutor’s Office (FEJA), headed by Dr. Juan Rozas, and are subject to judicial approval.
Under this framework, the Lottery plays a central role in the execution of the measures ordered by the courts. Its responsibilities include delivering educational programs, coordinating economic restitution for damages linked to illegal gaming activities and supervising community service tasks imposed on defendants.
The initiative positions the regulator as an operational link between the judicial system and enforcement mechanisms aimed at curbing unauthorized betting. By channeling remedial actions through the regulatory authority, the program seeks to combine punitive and preventive approaches, focusing not only on sanctions but also on awareness and compliance.
Article 301 bis of the Argentine Penal Code addresses offenses related to the organization, promotion or facilitation of unauthorized gaming operations. Cashiers charged under this provision are typically accused of enabling illegal betting activities at the point of sale.
Through probation agreements, courts may impose obligations such as financial restitution, participation in training programs and community service, instead of pursuing a full criminal trial.
According to the regulator, the program establishes a precedent for institutional coordination in illegal gaming cases, reinforcing collaborative efforts between prosecutors, courts and regulatory bodies. The framework is designed to strengthen prevention, control and awareness of the risks and broader social impact associated with illegal gambling.
The entity serves as the gaming regulatory authority within the jurisdiction of Buenos Aires City, overseeing licensing, compliance enforcement and consumer protection across legal gaming operations
