The New Jersey Assembly Tourism, Gaming and the Arts Committee unanimously approved AR 150, which urges heightened restrictions on gambling advertisements following the incident involving Philadelphia Phillies first baseman Bryce Harper and FanDuel. 

In November 2024, Harper filmed a 21-second video for FanDuel user Terry Thompson on Cameo, where the Major League Baseball (MLB) All-Star addresses Thompson – and his son – by name, while the clip is also marked with a FanDuel logo.

Harper then released a statement via social media to address the personalized video in July, saying FanDuel had “no right” to send it to Thomson and that he “did not know” the video would be used for commercial purposes, which went “beyond anything I knew about or approved.”

Despite the clarity Harper tries to provide for his perspective, the script he shared on social media included an attribution to “your host Bryttanni (Morgan) at FanDuel.”

Thompson sued FanDuel, Morgan, DraftKings, the NFL and Genius Sports for allegedly causing him to become a gambling addict in March 2026, leading to approximately $2m in losses.

The legislation in New Jersey urges restrictions on all gambling advertisements which target bettors who have displayed signs of addiction, with Committee Chair William Moen stating “this is something that we see as a problem.”

New Jersey’s Assembly Tourism, Gaming and the Arts Committee also approved legislation which requires self-excluded individuals to watch educational and counseling videos prior to removal from the lists.

Prior to going into effect, the New Jersey Division of Gaming Enforcement and Racing Commission would need to authorize regulations which govern how such programs may function. 

In August, FanDuel and Kindbridge Behavioral Health expanded their responsible gambling partnership, with a focus on prevention, self-assessment and access to professional support for customers.
