The Netherlands Gaming Authority, Kansspelautoriteit (KSA) has issued a directive to Toto Online for breaches of the Money Laundering and Terrorist Financing Prevention Act, citing inadequate monitoring of customer transactions and insufficient investigation into the origin of player funds.
According to the regulator, the operator failed to meet requirements for continuous monitoring of business relationships and transactions following initial customer due diligence.
The KSA said Toto Online did not sufficiently document why new facts or developments did not result in adjustments to customer risk classifications and failed to properly substantiate certain control measures applied.
The regulator also identified shortcomings in the operator's investigation of the origin of player funds. Under Dutch anti-money laundering rules, gaming providers are required to monitor player behavior and investigate potentially suspicious activity, including sudden or unusually large deposits.
The KSA has previously published guidance highlighting elevated risks associated with high-value deposits, including those originating from players' own bank accounts, which may require enhanced scrutiny.
The directive requires Toto Online to bring its operations into compliance within six months.
The authority said it will conduct a follow-up inspection after that period to assess whether the violations have been fully addressed. It also noted that the operator cooperated during the investigation and had already remedied part of the identified shortcomings before the directive was formally issued.
Toto Online operates in the Netherlands under the Toto and Winnitt brands and holds a licence in the regulated Dutch online gambling market. As a licence holder, the company is subject to ongoing supervision under the country's anti-money laundering and counter terrorist financing framework.
The directive reflects the regulator's broader enforcement approach in the Dutch market, where operators face continued scrutiny over their ability to detect and prevent potentially suspicious financial activity.
