Influencer accused of failing to deliver prize after announcing winner of online giveaway
Lawsuit claims lack of transparency and bad faith in management of promotional campaign
Plaintiff seeks delivery of prize and compensation for moral damages

Brazilian influencer Rayane Figliuzzi has become the defendant in a civil lawsuit related to the outcome of an online giveaway promoted on her social media profile.

According to Court documents, the case involves a promotional campaign carried out in partnership with the mobility company Gotrix Mobilidade Urbana, in which participants competed for an electric scooter as the main prize.

The lawsuit was filed by a participant in the promotion, who claims she was initially announced as the winner of the contest. Shortly afterward, however, Figliuzzi allegedly stated that the participant had not complied with all participation rules and therefore would not receive the prize.

The victim argues that she followed the required steps to enter the giveaway and says she presented evidence of compliance to the influencer after the dispute emerged. According to the filing, she claims her attempts to resolve the issue were ignored.

In parallel, the company involved in the campaign reportedly stated that it did not bear responsibility for the organization of the promotion, indicating that the influencer was responsible for managing the giveaway mechanics.

The lawsuit alleges bad faith and a lack of transparency in the conduct of the promotional action.

As part of the legal request, the plaintiff is asking the court to compel the defendants to deliver the promised electric scooter, valued at BR11,500 ($2,250), as well as pay BR10,000 in compensation for moral damages.

Authorities in Brazil have increasingly examined similar campaigns amid concerns that some online raffles may operate outside established promotional or gambling regulations.

Brazil's regulator, SPA, has also expanded oversight of influencer involvement in betting-related advertising.
