The Public Prosecutor’s Office of the Federal District and Territories (MPDFT) has opened a civil inquiry into Brabet over alleged irregularities involving consumer protection and responsible gambling practices on the operator’s platform.
The investigation targets Brabet.com, operated by Five Tech Games LTDA, and was formalized through Ordinance No. 1,025 signed by prosecutor Paulo Roberto Binicheski.
According to the MPDFT, the inquiry will examine reports of improper fund retention, arbitrary account suspensions, abusive bonus clauses and possible failures linked to responsible gambling policies.
The platform currently operates under authorization granted by LOTEP, the lottery authority of the Brazilian state of Paraíba.
Prosecutors stated that preliminary analysis identified potential violations of consumer rights and possible breaches of both regulatory and consumer protection standards. Among the issues under review are allegations involving withheld account balances and winnings, account blocks without adequate justification, and bonus rollover requirements considered abusive by consumers.
The inquiry will also assess Brabet’s anti-money laundering controls, data protection practices and self-exclusion system.
According to the MPDFT, some users reportedly continued accessing the platform and placing bets even after requesting voluntary self-exclusion measures designed to block gambling activity. Prosecutors indicated that such cases could represent failures in the operator’s obligations to prevent gambling-related harm.
The investigation was also supported by consumer complaints and information gathered from Brazilian consumer platform Reclame Aqui. According to figures cited by prosecutors, Brabet registered 567 complaints over the last 12 months.
While the company reportedly responded to all complaints, only 45% were considered resolved. Consumers assigned the operator an average score of 3.21 out of 10.
The MPDFT described the figures as possible evidence of a “systemic failure” in service provision.
Five Tech Games has been given 15 days to submit documents related to terms of use, responsible gambling policies, account suspension procedures, bonus structures and self-exclusion requests
