Influencer Deolane Bezerra and her son, Kayky Bezerra, have been named defendants in a damages lawsuit filed in November before the São Paulo Court of Justice.
The action was filed by an electrical assistant who alleges she was misled into joining an online gaming platform promoted by Kayky in 2023.
Court documents indicate that the woman accessed the platform through a link shared by Kayky in a messaging group.
She stated that she trusted the credibility of the influencer's son, who, according to her, made "ostensive publicity" for the game.
She claims she was attracted by promises of fast and substantial returns, ultimately accumulating winnings of BR60,000.
Her complaint alleges that once she attempted to withdraw the prize, the system blocked the transaction.
She told the Court she contacted the influencer directly, at which point he redirected her to another online gaming platform.
According to the filing, this created a cycle in which she was encouraged to remain within what she describes as a monetised fraudulent scheme.
The woman accuses the minor of misleading advertising through the abuse of personal prestige and argues he should be held responsible for the promised amount.
Although his mother did not participate in the alleged actions, she was included in the lawsuit because, at the time of the promotion, the boy was still a minor.
Under Brazilian law, parents can be held civilly liable for damages caused by underage children, regardless of direct involvement.
The plaintiff is seeking BR60,720 in compensation, representing both material and moral damages.
The case will now proceed through the civil court process, where the judge will determine whether the claims meet the criteria for liability and indemnification under Brazilian consumer and civil law.
