A court in Brazil has ruled against influencer Felipe Prior, ordering the removal of social media content that promoted “guaranteed” profits from sports betting.
The influencer promoted user sign-ups to the H2 Licensed platform through affiliate links.
Prior rose to fame on Big Brother Brasil, the national version of the reality show now sponsored by Betano, although his participation dates back to the 2020 season.
The decision also established a potential BR5m compensation for collective moral damages following a civil action brought by the Public Prosecutor’s Office of the Federal District.
The case targets both Prior and H2 Licensed over alleged misleading and abusive advertising practices.
According to the ruling, Prior must delete all posts that suggested bettors could achieve fixed returns within short timeframes, including claims of turning small stakes into significant profits within days.
He is also prohibited from publishing or promoting any content that associates betting with guaranteed income, absence of risk or assured reimbursement of losses.
Failure to comply may result in a daily fine of BR10,000, capped at BR100,000.
The Public Prosecutor’s Office argued that the influencer used his online presence to promote unrealistic outcomes, including claims that BR20 bets could generate BR5,000 within 24 hours, with alleged guarantees of refund in case of losses.
Authorities highlighted that such messaging misrepresents the inherent risks of betting and exploits consumer vulnerability.
The court found that the advertising strategy relied on credibility and influence to present betting as a safe and predictable source of income, effectively distorting its nature as a risk-based activity.
The influencer’s legal team has been granted 15 days to respond to the decision.
