Influencer confirms legal action after comments involving her children

Brazilian influencer Virginia Fonseca, the biggest one in the country in terms of followers, has defended her role promoting licensed betting platforms following public criticism that has reignited debate around gambling advertising and influencer responsibility.

The dispute began after actress Luana Piovani shared a post criticizing betting promotion and directly referenced Fonseca, linking her commercial activity to social harm associated with gambling. The post included remarks involving Fonseca’s children, prompting a strong response from the influencer.

Fonseca later stated she intends to pursue legal action over the comments, arguing that the criticism crossed personal boundaries by involving her family.

In a video response, she said the promotion activity was completely legal and believes the comments about her children are inappropriate attacks, especially due to being directed at minors.

The case sits within a broader and increasingly visible tension in Brazil’s betting market.

Since regulation was introduced under Law 14.790/2023, licensed operators have expanded marketing efforts, often relying on influencers and digital creators to reach audiences. At the same time, public debate has intensified around issues such as addiction, financial harm and the normalization of betting through advertising.

There’s currently a bill running in the country that would ban advertising for fixed-odds betting and online gambling across Brazil.

Recent high-profile testimonies, including that of a public sector auditor who linked gambling addiction to a personal family tragedy, have added emotional weight to the discussion and contributed to growing scrutiny of how betting is presented online.

While Fonseca’s partnership involves a licensed operator, the controversy reflects a wider challenge for the sector: balancing legal commercial activity with rising political and social pressure to tighten advertising standards.
