The New York Senate has chosen to unanimously pass A10329, which would require sports betting operators currently licensed in the Empire State to send users monthly betting statements beginning on January 1, 2027.
After also receiving unanimous approval from the New York Assembly, the legislation only requires a final signature from Governor Kathy Hochul prior to becoming law.
If approved, the betting statements would include activity such as deposits, wagers, winnings, losses, net win or loss, total wagers, time spent, bonuses and credits, information related to responsible gambling tools and access to a user’s complete betting history.
The motive behind A10329 is to help identify potential warning signs of problem gambling, while the legislation would not alter the tax revenue generated by regulated sports betting or the payments issued by operators.
On September 21, a New York Times report raised serious allegations against DraftKings, noting that the operator allegedly uses AI-powered data analysis to target gamblers most likely to lose.
The outlet alleges it obtained internal documents and interviewed dozens of former DraftKings employees, naming Data Analyst Jayden Butts as one of its sources. According to the report, spent hundreds of millions of dollars on promotional incentives, bonuses and so-called “free bets,” as well as on marketing such practices.
According to other unnamed former employees, DraftKings reportedly uses data science to target losing gamblers with promotions, while efforts to identify problem gamblers were stalled or dropped.
DraftKings told the New York Times it “rejects any implication” that its marketing unfairly targets customers, saying promotions are based on sustained, engaged use of the platform rather than how much players lose.
The New York State Gaming Commission also reported the state’s mobile sports wagering activity for August 2026 on September 11, as operators produced $168.5m of gross gaming revenue, representing a decrease of 5.5%.
During the monthly period, New York’s online sports betting handle also decreased year-over-year, falling 15.3% to $1.73bn.
