Germany's Joint Gambling Authority of the Federal States (GGL) has published new guidance explaining when online gambling advertising is permitted and the restrictions that apply to operators.
The FAQ coincides with Germany's nationwide Gambling Addiction Awareness Day, which this year focused on concerns surrounding gambling advertising and player protection.
Under the 2021 State Treaty on Gambling, advertising and sponsorship for licensed gambling are generally permitted. The regulatory framework is partly intended to channel existing gambling demand towards licensed and supervised operators, while imposing controls intended to protect players and minors.
However, restrictions vary by gambling product and advertising format. Radio and internet advertising for virtual slots, online poker and online casino games is prohibited between 6am and 9pm. Sports betting advertising is also restricted immediately before and during live broadcasts of the sporting event being promoted.
Advertising must not target minors or other vulnerable groups, minimise gambling-related risks or present gambling as a way of resolving financial difficulties. Additional requirements apply to areas including direct marketing and promotional bonuses.
The GGL's guidance also addresses social media, streaming, sponsorship and influencer marketing. Social media gambling advertising is not automatically prohibited, but remains subject to the same regulatory framework, while advertising illegal gambling is prohibited.
Consumers can determine whether an operator holds a German licence by checking the official whitelist. The GGL noted that an operator appearing on the list does not mean every advertisement it publishes automatically complies with advertising rules.
The regulator is also encouraging the public to report suspected violations, including advertisements for unlicensed gambling, with screenshots and details such as the website, date and advertising medium where possible.
In August, the GGL warned that social betting and prediction markets are illegal in Germany and participation may constitute a criminal offence
