Chile: Bill to ban online gambling
Key Points
All online gambling platforms would be banned from operating and advertising in the country
Operators could be fined between $14,480 and $364,238
Land-based casinos and horseracing are allowed to continue to operate

The Chilean Senate has proposed two amendments to the online gambling bill submitted in 2022: one of which completely bans all platforms, the other would allow already authorized lotteries to continue.

The deadline for submitting amendments closed on October 26, with more than 500 suggestions made. Among the proposed changes, Senators Ibáñez and Saavedra completely replaced the text of Article 1 with: "It is prohibited to develop, operate, manage, offer, broker, or advertise, directly or indirectly, online gambling platforms that operate in Chile.”

According to the proposed bill, platforms are considered to be operating in the country if they allow betting from within the national territory, regardless of the location of their infrastructure.

Violators would face imprisonment for six months to three years and fines ranging from $14,480 to $72,844.

The second proposal, from Senator Núñez, seeks to allow the Chilean Charity Lottery and Concepción Lottery, through the University of Concepción, to continue operating within the country.

This suggestion would also increase fines for illegal operators to between $72,821 and $364,238, and between $14,566 and $145,667 for advertising these platforms.

The bill would not interfere with land-based casinos and horseracing, which will be allowed to continue to operate. In October, the Superintendency of Casino Gaming (SCJ) reopened the tender for two casino operating permits in Chile.

The tender came amid a challenging period for casino licensing in the country, as the SCJ declared in August that two applications in Puerto Varas were unsuccessful because they did not fully meet the legal and regulatory requirements.

Good to know

The proposed bill is in its second constitutional review in the Senate, which originally approved it in August 2025, with 27 votes in favor, 3 against and 5 abstentions
